On March 2, 2012 the Journal of Medical Ethics published: After birth abortion – why should the baby live? Written by Alberto Giubilini and Francesca Minerva, on why it should be acceptable to kill a human baby either at birth or within a few days after birth. Although they do not put an end time on when this act would no longer be permissible, leaving it instead up to the doctors to make that determination.
The main argument is that fetuses and newborns are not inherently gifted the right to life because they are not “persons”. While they have the potential to be “persons”, they are not born so. In addition the authors state that “persons” could mean ‘non human animals’. Their definition to be a “person”(s), a being only needs to attribute to its own existence. Therefore, anything in the animal kingdom can be a “person”. The authors also state that established persons have the right to determine the continued existence of the newborn regardless of the newborns future potential. Who are these established persons? As I said any animal, also parents, siblings or society. Here is a simple example of this reasoning in action: Day three of newborns life, the woman can’t take the pressure, house is in chaos, she hasn’t slept for days now, and the dog hates to competition making the woman’s life a mess. Woman takes newborn to hospital and has an ‘after birth abortion’ performed. No adoption because the thought of future complications of the adult newborn is undesirable. The criteria has been met for the after birth abortion; 1. The newborn is not a person yet and 2. The actual persons (woman and dog) do not wish to continue the life of the newborn. Woman goes home and takes a long nap with dog.
The more ominous argument used is the female identifier. Not once in the entire document is the newborn identified as anything other than she or her. This is apparent in their first point: “a right to X is that she is harmed by a decision to deprive her of X” In additions the male identifier is never mentioned either as a newborn or parent.
As is common, the truth is often more simple than the words used to describe it. By using the authors own arguments, we can only conclude that females are not “persons” unless two criteria are met 1. Importance is place don’t he female newborn by her mother, siblings and society and 2. She can attribute to her own existence.
Should this become the prevailing policy in the United States, as it has been in China, then we females have lost everything that we have gained over the last 40 years. Be very careful when the argument for right of reproduction is used to argue right to exist.
